I do not allow my art to be used for any purposes involved with AI and alike. Please do not upload it to any AI sites as this could compromise my artwork.
NFT usage is striclty prohibited.

[USER AGREEMENT]
By commissioning AIN ARTISTO ("the artist"), the client guarantees that they have read and accepted all the terms metioned herein.
The client will agree to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provides all image credits to the artist.
Violations of contract will end in blacklisting the breacher without notice. Legal charges will be pressed.
[SCHEduling]
The artists will reply to inquiries within approximately 1-7 business days. Requests can be made over the OFFICIAL APPLICATION LINKTwitter DM's or E-Mail.
If the artist accepts the request, the client may hand over all of their reference material and explain the outline and scope of the project, free of charge.
If there are deadlines to be met, the client is obligated to reveal them beforehand.
After discussing all neccessary details, both sides will agree on an estimated starting date for the commission.
To reserve the aforementioned time slot, the client is obligated to make an advance payment.
The client will be notified if there are any delays with their commission.

Payment is done via a STRIPE link or BANKTRANSFER.
The artist won't accomodate to your personal issues with payment.
Listed prices on the website or commission document are estimated starting amounts and may be individually adjusted to fit the project scale.​​​​​​​

[COMMERCIAL rights AGREEMENT]
The artist differentiates between the BASIC COMMERCIAL RIGHTS and the FULL COMMERCIAL RIGHTS.
The two setups are defined as follows:
[basic commercial rights]
Marked with COMM.
Using the artists work for display, streaming or content creation.
For (aspiring) VTubers, these rights allow you to the design as a reference for their model artist, so they can present the model with the design or outfit on stream or video.
In the case of an illustration, 
the same rules will apply.
[FULL COMMERCIAL RIGHTS]​​​​​​​
The following cases are considered commercial use and require purchasing the FULL COMMERCIAL RIGHTS: 

Reproducing and selling the artwork/design or parts of it publicly or privately
(f.e. merch using the new design, promotional videos on a bigger scale, etc.)

Cases where the client receives profit from a medium/platform where they 
posted the artwork itself or an artwork with the design - f.e. Patreon, YouTube, Twitch,
a personal site, business cards etc.

The additional amount will have to be calculated seperately.
The minimum price increase is +100% of the original price.
[COPYRIGHT]
The artist reserves the right to sign and/or watermark their own work. 
The artist will send the client a full resolution image (by email or via google drive), but the signature will remain on both the full resolution and smaller versions of the Artwork.
The artist retains all copyright over their work, which includes the right to redistribute, reproduce, or use the image as a sample for sales, merchandise or self-promotion
unless otherwise agreed upon. 
In the case of a public commission, the artist may do whatever they wish with the art (eg. post it to other sites such as Instagram) but will give proper credit
to the client for ownership of the character’s design.
The artist will not claim the rights to a character design unless it was one of their own designs.
Therefore the artist will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.
In the case of an adoptable design, the artist will not reuse/resell the rights to the design once ownership is transferred to the client, but they may still be posted on the artists portfolio or printed in their artbook collections.
Scrapped early designs may be reused, recolored and reworked in order to sell them as adoptables in the future.

[advance payment]
After discussing the commission specifics and scheduling a slot, the client must submit an advance payment of 150€ to secure their spot.
The early payment serves as a security mechanism and indicates that both parties have reached an agreement.
Once the declared date approaches, the difference between the advance payment and the grand total of the booked commission must be payed upfront and in full. 
Depending on the commission schedule, the artist will send out a notification 1-2 months in advance, which acts as a reminder.
An additional reminder will be sent 2-3 weeks before the due date to collect any remaining payments.

[RUSH FEe]

Only applies to commissions with a deadline shorter than 21 business days.
This fee is additionally charged with +30% of the original commission price. 
[TERMINATION and refund policy]
Early cancellations are accepted 6 weeks prior to the estimated starting date of the commission. 
In case of an early cancellation, the advance payment will be fully refunded within 7 business days.
However, if the client fails to cancel their commission by the early cancellation period, the upfront payment will not be returned.
In this instance, the client may request to reschedule the commission based on the artist's availability once. If the negotiation fails, the advance payment will not be repaid.
If the client terminates the contract once production has begun, the client will be refunded with an amount relative to the commissions process:
 F.E: The commission is canceled after 40% of the progress has already been made = the client will receive a 60% refund.
Designs that are refunded may be overworked, reused and sold as adoptables in the future.

[FINAL PRODUCT]
There may be slight differences between the samples in the artists gallery and the illustration the client will receive.​​​​​​​
The artist reserves the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.
The client is responsible for saving any information, images, and other digital data the artist provides.
Any file the client paid for will be available for a finite time only. The artist preserves files for up to 3 months. However, the artist cannot guarantee accidental data deletion or loss.
The artist is not required to post the project in any public space, and if posted, is not required to keep it there indefinitely. 
The artist has the right to delete or remove any public project.
